IN THE SUPERIOR COURT OF THE STATE OF WASHINGTON FOR SPOKANE COUNTY NO. 2009-02-05232-2 SHERIFF'S NOTICE TO JUDGMENT DEBTORS OF SALE OF REAL PROPERTY WELLS FARGO BANK, N.A., ITS SUCCESSORS AND/OR ASSIGNS, Plaintiff vs THE UNKNOWN HEIRS AND ASSIGNS OF DELBERT M. CATE; THE UNKNOWN DEVISEES OF DELBERT M. CATE; THE UNKNOWN HEIRS AND ASSIGNS OF HILDA E. CATE; THE UNKNOWN DEVISEES OF HILDA E. CATE; STATE OF WASHINGTON DEPARTMENT OF SOCIAL AND HEALTH SERVICES; and DOES 1 through 20, inclusive, Defendants TO: The Unknown Heirs and Assigns of Delbert M. Cate, The Unknown Devisees of Delbert M. Cate, The Unknown Heirs and Assigns of Hilda E. Cate, and The Unknown Devisees of Hilda E. Cate. An Amended Writ of Execution on Real Property has been issued in the above-captioned case, directed to the Sheriff of Spokane County, commanding the sheriff as follows: WHEREAS, on June 14, 2013, Plaintiff Wells Fargo Bank, N.A. obtained a Default Judgment ("Judgment") in the Superior Court of Washington, County of Spokane, against Defendants The Unknown Heirs and Assigns of Delbert M. Cate, The Unknown Devisees of Delbert M. Cate, The Unknown Heirs and Assigns of Hilda E. Cate and The Unknown Devisees of Hilda E. Cate ("Defendants"). A true and correct copy of the Judgment is attached hereto as Exhibit A and incorporated herein by reference. It is ordered and adjudged that the land and premises located at 4814 N. Elgin Street, Spokane, WA 99205, and legally described as: LOT TWENTY-ONE (21) IN BLOCK FOURTEEN (14) MOUNT PLEASANT FIRST ADDITION IN THE CITY OF SPOKANE COUNTY OF SPOKANE AND STATE OF WASHINGTON, AS PER MAP THEREOF IN BOOK 'N' OF PLATS, PAGE 50, IN THE OFFICE OF THE COUNTY AUDITOR OF SAID COUNTY. ("Subject Property") referred to in the Judgment, be sold at public auction, as particularly set out in said Judgment. The total amount due and owing on the Judgment through June 14, 2013, is $143,761.06, consisting of the following: the Judgment amount of $132,755.89, plus $5,655.00 awarded for attorney's fees, $3,806.67 awarded for litigation costs, plus post-judgment interest accruing at the legal rate of 12% per annum, and pursuant to paragraph d of the Judgment, post-judgment amounts advanced for attorney's fees of $1,543.50, and costs for publication and sheriff's fees of an unknown amount. In the name of the State of Washington, you are hereby commanded and required to proceed to notice for sale and to sell the Subject Property, which is more particularly described in the Notice of Sale, and apply the proceeds of said sale as in said Judgment directed, and to make and file your report of such sale with the Clerk of this Court, and do all things according to the terms and requirements of said Judgment, and the provisions of Washington law. Pursuant to the Judgment, the Subject Property is not subject to a redemption period. In accordance with RCW 61.12.093, Plaintiff waived all deficiency rights related to the Subject Property, the subject loan was more than six (6) months in default, and the Subject Property was abandoned by the borrower and unoccupied for more than six (6) months. The sale date has been set for the 27th day of September, 2013, 10:00 a.m. at the South Entrance of the Spokane County Court- house, 1116 W. Broadway Ave., Spokane, WA. YOU MAY HAVE A RIGHT TO EXEMPT PROPERTY from the sale under statutes of this state, including sections 6.13.010, 6.13.030, 6.13.040, 6.15.010, and 6.15.060 of the Revised Code of Washington, in the manner described in those statutes.
