MCCARTHY; AND UNKNOWN PERSONS IN POSSESSION OR CLAIMING RIGHT TO POSSESSION, Defendants * * * * * * * * * * * * * * * * TO: THE ESTATE OF JOLAYNE LUCEY, DECEASED and THE UNKNOWN HEIRS AND DEVISEES OF JOLAYNE LUCEY, DECEASED. An Order of Sale has been issued in the above-captioned case, directed to the Sheriff of Spokane County, commanding the sheriff as follows: WHEREAS, in the above-entitled court on July 18, 2013, Plaintiff, secured a judgment against defendants THE ESTATE OF JOLAYNE LUCEY, DECEASED and THE UNKNOWN HEIRS AND DEVISEES OF JOLAYNE LUCEY, DECEASED, in the amount of $60,155.80, together with interest at an adjustable rate, $3.70 per diem from June 11, 2013 through the date of judgment and continuing thereafter until the date of sale. WHEREAS, 38 days elapsed from June 11, 2013 through the entry of judgment on July 18, 2013. Per diem interest in the amount of $3.70 multiplied by 38 days results in additional interest in the amount of $140.60, which when added to the sum of $60,155.80 results in a total judgment amount of $60,296.40. WHEREAS, the judgment is a foreclosure against parties of a Deed of Trust Mortgage on real estate in Spokane County, Washington, described as follows: LOT 2, BLOCK 12, FOREST GABLES FIRST ADDITION, AS PER PLAT RECORDED IN VOLUME 1 OF PLATS, PAGE 93, RECORDS OF SPOKANE COUNTY; SITUATE IN THE CITY OF SPOKANE, COUNTY OF SPOKANE, STATE OF WASHINGTON. Tax Parcel No. 26352-0308 and commonly known as: 5914 N Sutherlin, Spokane, WA 99205 WHEREAS, on July 18, 2013, the Court ordered that all of the above-described property be sold and the proceeds applied to the payment of principal, interest, attorney fees, costs and disbursements and other recovery amounts with interest to date of the sale of the property. NOW, THEREFORE, in the name of the STATE OF WASHINGTON, you are hereby commanded to proceed to seize and sell forthwith and without appraisement, the property above-described, in the manner provided by law, or so much thereof as may be necessary to satisfy the judgment amount plus interest to the date of sale. The redemption period is 0 months. The Sheriff's notice of sale shall be published in the Valley Voice. The sale date has been set for the 20th day of December, 2013, 10:00 a.m. at the South Entrance of the Spokane County Courthouse, 1116 W. Broadway Ave., Spokane, WA. YOU MAY HAVE A RIGHT TO EXEMPT PROPERTY from the sale under statutes of this state, including sections 6.13.010, 6.13.030, 6.13.040, 6.15.010, and 6.15.060 of the Revised Code of Washington, in the manner described in those statutes.
