NOTICE OF TRUSTEE'S SALE. NOTICE IS HEREBY GIVEN that the undersigned Trustee, Bruce J. Blohowiak will, on March 14th 2014 at the hour of 10:00 a.m., inside the main entrance of the Spokane County Courthouse, 1116 Broadway, Spokane, WA 99260 sell at public auction to the highest and best bidder, payable at the time of sale, the following described real property, situated in the County of Spokane, State of Washington, to-wit: That portion of the Southwest quarter of the Southwest quarter of Section 2, Township 23 North, Range 42 East of the Willamette Meridian, described as follows: Beginning at the Southwest corner of said Section 2;Thence North along the West line of said section a distance of 480 feet; Thence East on a line parallel with the South line of said section a distance of 517 feet more or less to the Westerly right of way line of Curtis Road; Thence Southwesterly along said Westerly right of way a distance of 495 feet more or less to the South line of said Section 2;Thence Westerly along the South line of said section a distance of 397 feet more or less to the Point of Beginning; Including the Mobile Home located thereon (Tamarack Mobile Home VIN#164952D6963) Situated in the County of Spokane, State of Washington. The postal address of which it is more commonly known as: 16016 S. Curtis Road, Cheney, WA 99004. The above described real property is subject to a Deed of Trust dated March 15th 1988 wherein Timothy James Anderson, is the Grantor and recorded on the 22nd day of April 1988 under Recording Number 8804220118 records of Spokane County, Washington, Washington wherein Spokane County Title is the Trustee and Frank Smith Parker the Beneficiary. The Beneficial interest in the Deed of Trust was assigned to Freedom Financial LLC by an Assignment of Deed of Trust, recorded February 9th 2006, under Recording No. 5341419, records of Spokane County, Washington. II. No action commenced by the beneficiary of the Deed of Trust is now pending to seek satisfaction of the obligation in any Court by reason of the Borrower's or Grantor's default on the obligation secured by the Deed of Trust. III. The default(s) for which this foreclosure is made is/are as follows: Failure to pay when due the following amounts which are now in arrears: 1. Failure to pay monthly payments in the amount of $505.00 for the month of February 2013 through August 2013: $ 3,535.00. 2. The failure to pay Late Charges: $ 148.50. 3. Current foreclosure costs and fees: a. Cost of Title Report for foreclosure $ 293.49 b. Service/Posting Notice of Default $45.00 c. Copying (est) $5.00 d. Postage (est) $14.16 e. Attorney's Fee $700.00 f. Demand Notice $50.00 g. Property Inspections (2) $113.00. TOTAL CHARGES, COSTS AND FEES: $ 4,895.65. IV. The sum owing on the obligation(s) secured by the Deed of Trust are as follows: Principal $ 19,467.07 together with interest as provided in the note or other instrument secured from January 28th 2013 and/or as advanced and such other costs and fees as are due under the note or other instrument secured, and as are provided by statute. V. The above-described real property will be sold to satisfy the expense of sale and the obligation secured by the Deed of Trust as provided by statute. The sale will be made without warranty, express or implied regarding title, possession, or encumbrances on March 14th 2014. The default(s) referred to in paragraph III, must be cured by March 3rd 2014 (11 days before the sale date), to cause a discontinuance of the sale. The sale will be discontinued and terminated if at any time on or before March 3rd 2014, the default(s) as set forth in paragraph III is/are cured and the Trustee's fees and costs are paid. The sale may be terminated any time after March 3rd 2014 and before the sale, by the Borrower, Grantor(s), any Guarantor, or the holder of any recorded junior lien or encumbrance paying the entire principal and interest secured by the Deed of Trust, plus costs, fees, and advances, if any, made pursuant to the terms of the obligation and/or Deed of Trust, and curing all other defaults. VI. A written notice of default was transmitted by the Beneficiary or Trustee to the Borrower and Grantor at the following addresses: Timothy James Anderson 16016 S. Curtis Rd. Cheney, WA 99004; Timothy James Anderson, Route 3, Box 186, Cheney, WA 9900 by both first-class and certified mail on the 17th day of July 2013 proof of which is in the possession of the Trustee; and the Borrower and Grantor were personally served on the 18th day of July 2013 with said written notice of default or the written notice of default was posted in a conspicuous place on the real property described in paragraph I above, and the Trustee has possession of proof of such service or posting. VII. The Trustee whose name and address are set forth below will provide in writing to anyone requesting it, a statement of all costs and fees due at any time prior to the sale. VIII. The effect of the sale will be to deprive the Grantor and all those who hold by, through or under the Grantor of all their interest in the above-described property. IX Anyone having any objection to this sale on any grounds whatsoever will be afforded an opportunity to be heard as to those objections if they bring a lawsuit to restrain the sale pursuant to RCW 61.24.130. NOTICE TO OCCUPANTS OR TENANTS The Purchaser at the trustee's sale is entitled to possession of the property on the 20th day following the sale, as against the grantor under the Deed of Trust (the owner) and anyone having an interest junior to the Deed of Trust, including occupants who are not tenants. After the 20th day following the sale the purchaser has the right to evict occupants who are not tenants by summary proceedings under chapter 59.12 RCW. For tenant-occupied property, the purchaser shall provide a tenant with written notice in accordance with RCW 61.24.060 and the Helping Families Save Their Homes Act of 2009. XI.THIS IS AN ATTEMPT TO COLLECT A DEBT AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE XII. CONDITIONS OF SALE.
