BEFORE THE BOARD OF COUNTY COMMISSIONERS OF SPOKANE COUNTY, WASHINGTON NOTICE OF PUBLIC HEARING / AUCTION IN THE MATTER OF CONSIDERING THE SALE OF COUNTY OWNED PROPERTY ASSESSOR'S PARCEL NO. 37324.1714 ROAD FILE No. 2237 NOTICE IS HEREBY GIVEN, by the Board of County Commissioners of Spokane County (hereinafter referred to as the "Board"), pursuant to the provisions of RCW 36.34.020 and Spokane County Code Chapter 1.56, that a public hearing will be held at 5:30 p.m. or as soon as possible thereafter on the 25th day of February, 2014, in the Commissioners' Hearing Room in the Spokane County Public Works Building at 1026 W. Broadway Avenue, Spokane, Washington, 99260. The purpose of the public hearing will be for the Board to consider public testimony and the propriety and advisability of the sale of land located on the northeast corner of Greenleaf Drive and Brooklawn Drive, Spokane County Assessor's Parcel No. 37324.1714. The Board has received a written offer to purchase the property in the amount of $50,000; contingent upon financing, an acceptable title report, and an acceptable geotechnical site evaluation. At the public hearing the Board will consider whether to accept the written offer. The Board will consider any other written offers on the County Form or oral offers at the public hearing. No offer will be considered which contains a real estate commission to be paid by the County. If the Board receives any verbal offers at the public hearing in excess of the advertised offer, the verbal offer shall be reduced to writing on the County Form and submitted to the Spokane County Engineer's Office by 5:00 P.M. the next day to be considered a valid offer. If no additional written or verbal offers are received at the public hearing, the Board, at its sole option, may accept the advertised written offer. If only written offers are received at the public hearing, the Board, at its sole option, may accept the highest written offer. If the highest offer at the public hearing is a verbal offer, the Board shall continue the matter to the next meeting of the Board to make a decision on the offers presented. If the highest bidder does not reduce to writing their verbal offer, the Board, with the agreement of the next highest verbal or written bidder, may accept the next highest bidder's offer. The PROPERTY that is the subject of the sale is legally described as follows: ASSESSOR'S PARCEL NO. 37324.1714 That portion of Lot 11, Block 3 of Pine River Park First Addition as per plat thereof recorded in Volume 7 of Plats, Page 59, in Spokane County and a portion of that property described in Quit Claim Deed to Spokane County recorded by instrument number 9212170464 on December 17, 1992 also in Spokane County lying easterly of a line described as follows: Beginning at Engineer's Station 13+00 as shown on County Road Project No. 2237 right of way plan Greenleaf Drive Bridge No 3715 on file with Spokane County Engineers. Thence Northeasterly at 90 degrees to said centerline 30 feet to the true point of beginning for this line description. Thence northwesterly parallel to with and 30 feet distant from said centerline to station 15+00; thence northeasterly at 90 degrees to said centerline 5 feet; thence northwesterly parallel with and 35 feet northeasterly of said centerline to northerly line of said Quitclaim Deed. Excepting there from any portion lying southwesterly of a 20 foot radius at the southwesterly corner beginning at a point 30 feet easterly of said centerline as shown on said right of way plans and ending at a point beginning 25 feet northerly of the centerline of Brooklawn Road as shown on said Plat of Pine River Park Addition. Retaining an easement for repairs and staging for Greenleaf bridge, said easement document may be viewed on the County's Website at "WWW.SpokaneCounty.org" under "Surplus Properties" under "Surplus Property Listings" under "37324.1714 - Little Spokane River House Lot - Surplus Property" or may be viewed at the County Engineering Office. Located in the Southeast Quarter (SE ¼) of Section 32, Township 27 North, Range 43 East, W.M., Spokane County, Washington. Subject to all existing encumbrances, including easements, restrictions, and reservations, if any. A Reasonable Use Exception was acquired for the property No. RUN-62-08 and may be viewed at the said website or the County Building and Planning Office. Information regarding the property and the pending offers is available at the Office of the County Engineer, Public Works Building, 1026 W. Broadway Avenue, Spokane, Washington 99260. All meetings and hearings will be conducted in facilities that are accessible to all members of the public.
