MONTANA GENERAL STATE-WIDE WATER RIGHTS ADJUDICATION NOTICE OF PETITION TO THE MONTANA WATER COURT TO PRESERVE TESTIMONY The Confederated Salish and Kootenai Tribes of the Flathead Indian Reservation, located in Western Montana, give notice of their intent to take the deposition of Professor William E. Farr, Ph.D., for the purpose of preserving his testimony for use in the Montana state-wide general water rights adjudication, an adjudication proceeding under the Montana Water Use Act, 85-2-201 Montana Codes Annotated (2013). Dr. Farr has conducted historical research on behalf of the Petitioner Tribes for over twenty years. His expert testimony will address the genesis of the Treaty of Hellgate, July 16, 1855 (12 Stat. 975) and the Tribes' reliance upon hunting, fishing, trapping, camping and travel throughout the Tribes' aboriginal territory. His testimony will include information and documentation he has studied, developed and used to support his expert opinions concerning these matters and mapping of reported sites east and west of the Continental Divide. A hearing before the Montana Water Court will be held on April 25, 2014, or as soon thereafter as counsel can be heard.
