NO. 2014-0824 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF SPOKANE COUNTY, WASHINGTON NOTICE OF PUBLIC HEARING IN THE MATTER OF AMENDING / REVISING / REPLEALING CERTAIN SECTIONS WIHTIN SPOKANE COUNTY CODE CHAPTER 8.56, COMMONLY REFERRED TO AS THE SPOKANE COUNTY FLOW CONTROL ORDINANCE, EFFECTIVE WITHIN THE UNINCORPORATED AREAS OF SPOKANE COUNTY AND WITHIN THE BOUNDARIES OF THOSE ENTITIES CONTRACTING WITH SPOKANE COUNTY FOR SOLID WASTE DISPOSAL; REPEALING SPOKANE COUNTY CODE CHAPTER 8.20 AND OTHER MATTERS RELATED THERETO NOTICE IS HEREBY GIVEN by the Board of County Commissioners of Spokane County, Washington ("Board" or "Board of County Commissioners") pursuant to the provisions of Article 11§11 of the Washington State Constitution, RCW 36.32.120 (7), and RCW 36.58.040 that a public hearing will be held by the Board of County Commissioners on: Tuesday, November 4, 2014 at 2:30 P.M. or as soon as possible thereafter in the Commissioners Hearing Room Spokane County Public Works Building 1026 West Broadway Avenue Spokane, WA 99260 BACKGROUND Pursuant to the provisions of chapter 36.58 RCW, Spokane County has the legal authority to establish a system of solid waste handling for all unincorporated areas of Spokane County and for cities / towns and other public entities which have entered into interlocal agreements with Spokane County. Effective as of November 17, 2014, Spokane County will own, operate and maintain a County Regional Solid Waste System to replace the Spokane Regional System established in 1989. The integrity of the County Regional Solid Waste System and its effective administration are essential to promote the health, safety and general welfare of County residents. Consistent with the state law, the Board of County Commissioners deems it necessary to (1) amend / revise / repeal certain provisions within Spokane County Code chapter 8.56 (Regulation of Solid Waste Disposal) commonly referred to as the Spokane County Flow Control Ordinance, and (2) repeal Spokane County Code chapter 8.20 (Solid Waste Facilities) so that such chapters are consistent with the County's ownership, operation and maintenance of the County Regional Solid Waste System. PURPOSE OF PUBLIC HEARING The purpose of the above scheduled public hearing will be for Board of County Commissioners to consider public testimony and take action on: (1) Amending / revising / repealing certain sections of Spokane County Code chapter 8.56 (Regulation of Solid Waste Disposal) commonly referred to as the Spokane County Flow Control Ordinance. Such amendment s/ revisions / repeals will, among other matters, designate the County Regional System as the "System" as well as add monitoring and enforcement provisions to enforce the Flow Control Ordinance within the unincorporated areas of Spokane County and within those entitles which have contracted with Spokane County for solid waste handling, and (2) Repealing Spokane County Code chapter 8.20 (Solid Waste Facilities). The terminology "action" as used herein shall mean deliberate, discuss, consider, review, evaluate, make a collective decision or take a vote on the above captioned matter. Any person may appear at the date, time, and place set forth herein above and present testimony on the above referenced matters. To ensure that everyone attending the public hearing has an opportunity to speak, testimony may be limited to three (3) minutes per speaker. The Board of County Commissioners reserves the right to adjust the time frame allotted to speakers as well as hearing procedures during the public hearing. The Board's meetings and hearings are conducted in facilities which are accessible to disabled individuals.
