NOTICE OF PUBLIC HEARING AND SEPA DETERMINATION OF NONSIGNIFICANCE PROPOSED AMENDMENT TO CITY OF SPOKANE MUNICIPAL CODE, TITLE 17C MOBILE FOOD VENDING IN THE COMMERCIAL, INDUSTRIAL, DOWNTOWN AND CENTER AND CORRIDOR ZONES Notice is hereby given that there will be a public hearing before the City of Spokane Plan Commission on Wednesday, May 22, 2013 at 5:00 pm in the City Council Chambers, Lower Level of City Hall, 808 West Spokane Falls Boulevard, Spokane, Washington. File Number: Mobile Food Vending Project, revisions to Title 17C, Spokane Municipal Code Applicant: Planning Services Department, City of Spokane Location: Affects the Commercial, Industrial, Downtown and Center and Corridor Zones within the City of Spokane. Description of Proposal: The purpose of this proposal is to amend the City's Unified Development Code, Title 17C, to clarify the zones in which mobile food vending is a permitted use by amending the list of uses within the commercial, industrial, downtown and center and corridor zones, and allowing mobile food vending as a limited use in these zones. The limitation will specify that mobile food vendors must be licensed pursuant to SMC Title 10 Division II, Mobile Food Vendor Licensing which will be a new license category. Currently mobile food vending is permitted generically in any zone which allows retail or service uses. This proposal is a change to the municipal code, not a land use change. SEPA: These proposed changes were reviewed under the State Environmental Policy Act (SEPA) under Spokane Municipal Code Section 17E.050. A Determination of Nonsignificance (DNS) was issued on May 7, 2013. The appeal deadline is May 21, 2013. Public Hearing Process The Plan Commission will hold a Public Hearing on this matter. After the Plan Commission Public Hearing the Plan Commission shall consider the proposal and forward a recommendation to the City Council. A City Council Hearing date will then be set. The City Council hearing date has not yet been determined. Notices of Public Hearing will be posted and published in the Spokesman Review and the Official City Gazette. These notices will contain the date, time and location of the public hearings. Written comments and oral testimony at the subsequent public hearings for this proposed action will be made part of the public record. Only the applicant, persons submitting written comments and persons testifying at a hearing may appeal the decision of the Plan Commission and City Council.
