State law further sets forth a process wherein counties may contract with one or more vendors for the design, construction, or operation, of, or other services related to, solid waste handling systems, plants, sites, or other facilities. Spokane County is in the process of contracting with a vendor for the operation of certain facilities known as transfer stations to be used in conjunction with the Spokane Regional Solid Waste System. In conjunction with such contract, the County desire to transfer the ownership of certain personal property to be used solely by the operator in conjunction with it's the operation of the transfer stations. Transfer of the ownership of such personal property under these unique circumstances is not presently provided for under chapter 36.34 RCW or Spokane County Code Chapter 1.56. However, Spokane County can provide for the transfer of the ownership of personal property to the operator of the transfer stations by adding a new section to Spokane County Code Chapter 1.56. PURPOSE OF PUBLIC HEARING The purpose of the above scheduled public hearing is for the Board of County Commissioners to consider public testimony and take action on (1) amending Spokane County Code Chapter 1.56 to modify Section 1.56.010, and (2) add an a new section to Spokane County Code Chapter 1.56 which would authorize the County to transfer the ownership of personal property owned by the County to a Transfer Stations operator. The modification of Spokane County Code Section 1.56.010 and new section to be added to Spokane County Code chapter 1.56 would provide as follows: ********** (Underlined language added, lined out language deleted.) 1.56.010 Purpose. The purpose of this chapter, prepared in accordance with RCW 36.34.005, is to provide effective management and protection for all county-owned real property, ensure the maximum return from all sales, rentals and leases of county real property and provide for disposing of all county real property not required for county purposes; provided, that the county shall retain all powers now or hereafter granted by RCW Chapter 36.34. Additionally, the purpose of this chapter is to provide for the transfer of ownership of county-owned personal property in conjunction with the terms and condition of a contract entered into pursuant to RCW 36.58.090. 1.56.180. Transfer of Personal Property. The provisions of RCW 36.34.010-.120 inclusive shall not apply to the transfer of ownership of personal property in accordance with the terms and conditions of a contract entered into pursuant to RCW 36.58.090. ********** Any person may appear at the date, time and place set forth hereinabove, and present testimony in support of or opposition to the modification of Spokane County Code Section 1.56.010 and proposed adoption of a new section.
